BUILD BEYOND LTD (“We”, “Us”, “Our”, or the “Company”) provides the ClientSpring software, LaunchPad hosting, and associated consulting services (collectively, the “Services”).

By purchasing, accessing, or using our Services, you (“You” or the “Customer”) agree to be bound by these Terms of Service (the “Agreement”).

2. THE SERVICES & BETA STATUS

2.1 Scope of Services: The Services may include:

ClientSpring: AI-powered software for digital product creation.

LaunchPad: Web hosting and marketing infrastructure.

Strategic Action Plan: Consulting and strategy formulation.

Backend Engine: Software upgrades and funnel generation.

2.2 Beta Notice: You acknowledge that parts of the Services (specifically ClientSpring and LaunchPad) are currently in a "Beta" phase. This means the software may contain bugs, errors, or experience interruptions. You accept these risks as part of the Beta access and agree that Build Beyond Ltd is not liable for data loss or downtime associated with the Beta nature of the software.

3. INTELLECTUAL PROPERTY (IP) RIGHTS

3.1 Our IP: Build Beyond Ltd retains all ownership rights, title, and interest in the ClientSpring software, the LaunchPad platform, the Backend Engine, our code, algorithms, templates, and trademarks.

3.2 Your Output (Generated Content): You retain 100% ownership of the specific text, images, and product files generated by you using our AI tools ("User Output"). You are free to sell, distribute, or modify this output as you see fit.

3.3 Liability for Content: You are solely responsible for the content you generate and publish. Build Beyond Ltd is not liable for any copyright infringement, trademark violations, or false statements contained within the content you generate using our tools. It is your responsibility to fact-check and verify all AI-generated output before publishing.

4. LAUNCHPAD HOSTING & ACCEPTABLE USE

If you purchase LaunchPad hosting, you agree to the following:

4.1 Acceptable Use Policy: You may not use our hosting services to publish, store, or distribute:

Illegal content or content that promotes illegal activities.

Adult content, pornography, or sexually explicit material.

Malware, viruses, or phishing scams.

Hate speech, harassment, or threats.

Content that infringes on the intellectual property of others.

4.2 Right to Suspend: We reserve the right to suspend or terminate your hosting immediately, without refund, if you violate this Acceptable Use Policy.

4.3 "Lifetime" Definition: References to "Lifetime Hosting" or "Lifetime Access" refer to the lifetime of the LaunchPad Service, not the lifetime of the customer. "Lifetime" is defined as the period during which Build Beyond Ltd continues to offer and support the LaunchPad platform. Should the service be discontinued, we will provide a minimum of 30 days' notice to allow for data migration.

5. DONE-FOR-YOU SERVICES

5.1 Setup: For packages including "Done-For-You" setup (e.g., LaunchPad VIP), our obligation is to configure the initial infrastructure (Domain, SSL, DNS). 5.2 Handover: Once the "Live" email is sent, the service is considered rendered. Ongoing management of the content and marketing is the responsibility of the Customer unless a separate management contract is signed.

6. FEES AND REFUNDS

6.1 30-Day Money Back Guarantee: We offer a 30-day money-back guarantee on our products. If you are not satisfied with the Services, you may request a refund within 30 days of your initial purchase date.

6.2 Refund Process: To request a refund, you must contact our support team at [email protected].

6.3 Subscriptions: For monthly subscriptions (e.g., LaunchPad Standard at $97/mo), you may cancel at any time. Cancellation will prevent future billing, but no refunds will be issued for partial months already used, outside of the initial 30-day guarantee period.

7. EARNINGS DISCLAIMER

7.1 No Income Guarantees: While our marketing materials may reference "6-figure businesses" or specific revenue figures, these are examples only. Build Beyond Ltd makes no guarantees regarding your ability to generate income using our tools. Your results depend on your work ethic, market conditions, and skills. 7.2 Reference to Separate Policy: For full details, please refer to our separate Earnings Disclaimer document.

8. LIMITATION OF LIABILITY

8.1 To the fullest extent permitted by English law, Build Beyond Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8.2 In no event shall our aggregate liability for all claims relating to the Services exceed the total amount paid by you to Build Beyond Ltd in the twelve (12) months preceding the claim.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England.
